GENERAL TERMS AND CONDITIONS – FINCA KAYU

1. Definitions

"Finca Kayu": The accommodation and property located in Coín, Málaga, Spain, owned and managed by Bart & Loes.
 "Guest": Any person or legal entity making a reservation or staying at Finca Kayu.
 "Agreement": The reservation agreement between the guest and Finca Kayu after successful payment.

2. Applicability

These terms apply to all offers, reservations, services and agreements with Finca Kayu. Deviations are only valid if confirmed in writing.

3. Booking and Payment

• Bookings are accepted only upon full prepayment via our website.
• The agreement becomes binding once payment is confirmed.

4. Cancellation and No-shows

• Cancellations are non-refundable.
• In case of no-show or cancellation, 100% of the booking amount is due.
• Exceptions are only considered in cases of force majeure (e.g. death of a direct relative) with written proof and Finca Kayu’s approval.

5. Check-in and Check-out

• Check-in: between 15:00 and 20:00.
• Check-out: no later than 11:00.
• Arrival outside these hours only upon prior approval.

6. Liability and Risk

• All stays at Finca Kayu are at the guest’s own risk.
• Finca Kayu accepts no liability for damage, loss, injury, or theft of any kind.
• The guest is liable for any damage caused by themselves or their companions.

7. Conduct and Rules

• Guests must adhere to the house rules, shared at check-in and available online.
• Misconduct (e.g. aggression, vandalism, harassment, excessive intoxication, disobedience) will result in immediate removal without refund.
• Severe misconduct may be reported to the authorities.

8. Food, Drinks and Facilities

• Food and drinks are only allowed on the terrace or in common areas.
• Absolutely no food or drinks allowed in rooms or near the pool.
• All consumption on the premises must be purchased from Finca Kayu.
• Pool access: 09:00–20:00, at own risk and in accordance with pool rules.
• The kitchen is for staff use only.

9. Pets

• No pets allowed by guests.
• The dog and cat on site are part of the household.

10. Smoking

• Smoking is only allowed in the designated area near the stairs by the barn.
• Smoking elsewhere is prohibited due to fire risk and disturbance.

11. Force Majeure

Finca Kayu is not responsible for disruptions caused by force majeure, such as weather events, pandemics, or power outages.

12. Acceptance of Terms

By making a reservation, the guest explicitly accepts these terms and conditions, which form an integral part of the agreement.
